Communication No. 02 of July 12th, 2007.


The National Technical Biosafety Commission (CTNBio), in
the use of its attributions established on Decree 5.591 of
November 22nd, 2005, that regulates dispositions of Law No.
11.105 of March 24th, 2005, and in accordance with what was
approved on the 103rd CTNBio Ordinary Meeting, that took
place on July 20th, 2006, determines the following
isolation conditions for authorization of planned release
in the environment of genetically modified eucalyptus.
1- Experimental areas surrounded by commercial plantation
of Eucalyptus.
These areas will not need borders, as long as a minimum
zone of amortization of one hundred meters (100m), with or
without trees, is respected. The proponent should:
a) Guarantee the elimination of commercial trees around
according to silviculture and industrial procedures, being
prohibited the collection and storage of seeds;
(b) Establish a minimum monitoring ray of one hundred
meters
(100m) to evaluate the arising of spontaneous plants and
eliminate them;
c) Circumscribe an experimental area exclusive to its
property, in order to guarantee the monitoring;
d) Guarantee the minimum distance of one kilometer (1km) in
relation to open orchards of seeds or Eucalyptus trees
sexually compatible and without commercial value.
e) Guarantee the minimum distance of three kilometers (3
km) in relation to areas (beehives) of commercial or
domestic apiculture, recognized as pre-existent at the time
of the experiment installation;
f) To be committed to warn apiculturist, eventually
interested in the installation of commercial beehives near
an already started experiment, which CTNBio authorizes, in
these cases, the minimum distance of one kilometer (1 km)
between the experimental area and the apiary.
2. Experimental areas located outside the commercial
plantation of Eucalyptus.
These areas should be surrounded by borders of fifteen (15)
meters containing, at least, five (5) rows of Eucalyptus
older than the plants under evaluation.
g) all recommendations on item (1) should be followed.
3. The authorization for Planned Release in the Environment
of GM Eucalyptus for resistance to insects may be granted
after proof by the proponent of the innocuousness of the
insecticide activity over pollinating insects such as Apis
mellifera.
4. Experiments with GM Eucalyptus, containing one or more
genes capable of granting adaptation advantages to the
plant, may have amplified areas of isolation and
monitoring, as well as on the borders. These areas are
defined case per case by CTNBio according to the genes, to
the environment and to the experimental practices proposed.
